1. Agreement to Terms

By engaging Berg Projects PTY Ltd ("we", "us", or "the Company") for any maintenance, construction, or related services, or by using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Berg Projects provides maintenance and construction services for residential properties, sectional title schemes, and residential estates. Our services include, but are not limited to:

General property maintenance and repairs
Plumbing and gas installations
Electrical work
Waterproofing and damp treatment
Painting and decorating
Roofing repairs and maintenance
Renovations and remodeling

3. Quotations and Pricing

3.1 Validity: All quotations are valid for 30 days from the date of issue unless otherwise specified in writing.

3.2 Scope: Quotations are based on the information provided at the time of assessment. Additional work discovered during the project may require a revised quotation.

3.3 Acceptance: Quotations must be accepted in writing (including email or WhatsApp) before work commences.

3.4 Price Adjustments: Prices may be subject to change if material costs increase significantly between quote acceptance and project commencement.

4. Payment Terms

4.1 Deposits: A deposit may be required before commencement of work. The deposit amount will be specified in the quotation.

4.2 Progress Payments: For larger projects, progress payments may be required at agreed milestones.

4.3 Final Payment: Final payment is due upon completion and sign-off of work, unless otherwise agreed in writing.

4.4 Late Payment: Interest may be charged on overdue accounts at the prevailing legal rate.

5. Work Standards and Compliance

5.1 Quality: All work will be performed to professional standards and in accordance with applicable South African National Standards (SANS) and building regulations.

5.2 Compliance: Where required, we will obtain necessary permits and ensure work complies with local authority regulations. Any additional costs for permits or inspections will be communicated upfront.

5.3 Certificates: Certificates of Compliance (CoC) for electrical, gas, or other regulated work will be provided where applicable.

6. Warranties and Guarantees

6.1 Workmanship: We provide a 12-month warranty on workmanship from the date of project completion, unless otherwise specified.

6.2 Materials: Material warranties are subject to the manufacturer's terms and conditions and are passed through to the client.

6.3 Exclusions: Warranties do not cover damage caused by misuse, neglect, natural disasters, or unauthorized modifications.

7. Access and Site Conditions

7.1 Access: The client agrees to provide reasonable access to the work site during agreed working hours.

7.2 Utilities: The client will provide access to water and electricity required for the work at no additional cost.

7.3 Site Preparation: Unless otherwise agreed, the client is responsible for clearing the work area and protecting valuable items.

8. Project Timeline

8.1 Estimated Timelines: Project timelines are estimates and may be affected by weather, material availability, or unforeseen circumstances.

8.2 Delays: We will communicate any significant delays as soon as reasonably possible.

9. Cancellation and Changes

9.1 Client Cancellation: If a client cancels after acceptance but before commencement, any materials ordered may be charged at cost. Deposits may be retained to cover administrative costs.

9.2 Scope Changes: Changes to the agreed scope of work must be confirmed in writing and may affect pricing and timeline.

10. Liability

10.1 Insurance: Berg Projects maintains public liability insurance and workman's compensation coverage.

10.2 Limitation: Our liability is limited to the value of the contract. We are not liable for indirect, consequential, or incidental damages.

10.3 Pre-existing Conditions: We are not responsible for pre-existing structural issues or hidden defects discovered during work.

11. Dispute Resolution

11.1 Good Faith: Both parties agree to attempt to resolve any disputes through good faith negotiation before pursuing legal action.

11.2 Jurisdiction: These terms are governed by South African law, and any disputes will be subject to the jurisdiction of the South African courts.
